Entrepreneur: The natural or legal person who offers products or services to consumers via distance selling.
Consumer: A person who buys something for personal use, not for business.
Distance communication: Any way of making a purchase without direct contact (like online, by phone, or email).
Distance contract: An agreement made completely through distance communication.
Right of withdrawal: The consumer’s right to cancel the purchase within a set period.
Cooling-off period: The time frame during which a consumer can cancel the order.
Day: A calendar day.
Ongoing agreement: A contract for products or services that continue over time.
Durable data carrier: Any tool that allows the consumer or entrepreneur to store information (for example, email or USB).
These terms apply to every online purchase between the entrepreneur and the consumer.
Before completing a purchase, the entrepreneur makes these terms available.
If this isn’t possible, the consumer will be told where to find them and can request a free copy.
If other terms also apply, the consumer can always rely on the version that is most favorable to them.
The agreement is made once the consumer accepts the offer and meets the stated conditions.
The entrepreneur confirms receipt of the order electronically.
The entrepreneur uses secure systems for data transfer and online payments.
The entrepreneur provides the consumer with clear information, including:
Contact details for complaints
Cancellation terms for ongoing contracts
Warranty and after-sales information
Instructions for using the right of withdrawal
The entrepreneur may check whether the consumer can meet payment obligations.
The offer will clearly state if it has a limited time or special conditions.
Descriptions of products or services must be accurate and clear.
The offer must clearly explain:
The total price including taxes
Delivery costs (if any)
How to order and pay
Delivery method and time
Whether the right of withdrawal applies
The duration of the contract if it continues over time
All prices include VAT and any additional costs must be clearly stated.
Prices will not change during the stated validity period, except if VAT rates change.
If prices depend on market fluctuations, this will be clearly mentioned.
Any price increases after an order allow the consumer to cancel.
Payment must always be made in advance, unless otherwise agreed in writing.
The order will only be processed after full payment has been received.
If the consumer fails to pay, the entrepreneur may charge reasonable collection costs after prior notice.
Any incorrect payment details must be corrected immediately by the consumer.
Consumers can cancel within 14 days after receiving the product without giving a reason.
The consumer may open the package only as needed to inspect the product.
The product must be returned in original condition and packaging.
For services, consumers can cancel within 14 days after the agreement starts.
The entrepreneur will provide clear instructions on how to cancel.
Only the return shipping costs are paid by the consumer.
The entrepreneur refunds the purchase amount within 30 days after receiving the return.
The right of withdrawal does not apply to:
Products that spoil or age quickly
Sealed audio/video/software once opened
Custom-made products
Newspapers or magazines
Personal or hygiene-related items
For services:
Once the service has started with the consumer’s consent
Travel, accommodation, or leisure services on specific dates
Consumers may cancel an ongoing contract at any time with one month’s notice.
Contracts automatically renewed become open-ended and can be canceled monthly.
The entrepreneur takes great care when handling and delivering orders.
Delivery happens to the address given by the consumer.
Orders are shipped as soon as possible, within 30 days, unless agreed otherwise.
If a product is unavailable, a similar replacement may be offered. The consumer can refuse it.
The entrepreneur bears the risk of loss or damage until delivery.
Any offered warranty does not affect the consumer’s legal rights regarding faulty products.
Products and services must meet the agreement, description, and normal quality standards.
The entrepreneur has a clear complaint procedure.
Complaints must be submitted promptly with a full description.
The entrepreneur will respond within 14 days. If more time is needed, the consumer will be informed.
If not resolved, the consumer can contact the Webshop Trustmark Foundation (Stichting Webshop Keurmerk) at www.keurmerk.info.
Any additional or different terms must not disadvantage the consumer and must be clearly written.
Changes only take effect after they are properly published. The most favorable version for the consumer applies.
All agreements between the entrepreneur and consumer are governed by Dutch law.
